TITLE II ADA ACCOMODATION


The ADA accommodation process is not for general financial assistance. The ADA accommodation process is for individuals with disabilities who need assistance accessing services, programs or activities made available by Tarrant County, Texas. This process does not pertain to complaints of discrimination under Title I of the ADA. The County does not have control over a particular Judge’s decision when a litigant seeks ADA accommodations that would modify court proceedings. Such a decision relates to a judge’s adjudicative responsibilities and is within a judge’s sole discretion.


ADA Grievance procedures


This grievance process is established to meet the requirements of Title II of the Americans with Disabilities Act of 1990 (ADA). It may be used by any person who wishes to file a grievance alleging discrimination[JH1.1] on the basis of disability in the provision of services, activities, programs or benefits by Tarrant County.


A grievance must be submitted as soon as possible but no later than 180 days after the occurrence of the alleged discrimination. This time limit may be extended as necessary at the discretion of Tarrant County. To submit a request, click REQUEST ACCOMMODATION to access the Tarrant County ADA Title II grievance Form. Tarrant County will provide appropriate assistance to persons with disabilities or who may be limited in their ability to communicate in English. In cases where the complainant is unable to complete the written online complaint form, the grievance may be made verbally or by other appropriate means. Grievances that concern the ADA Coordinator’s response to a previously submitted accommodation request will be forwarded to the Tarrant County ADA Committee for review and determination.


Review of Grievance.
An initial review will be conducted to determine if an investigation is warranted. If warranted, investigation will commence within 15 business days** of the grievance’s receipt. If needed, the County may send complainant a written request for additional information. Failure by the complainant to respond in a timely manner to the request for additional information may result in administrative closure of the complaint.


Determination. Within 30 business days** of the complaint’s receipt, the County will send complainant a written determination that includes, if applicable, any proposed options for resolution.


Appeal of County Determination. A complainant may appeal the County’s determination by sending a written appeal request, by email to ADARequests@tarrantcountytx.gov or by mail to the address below, within 15 business days of the determination’s delivery to the complainant:

Within 15 business days** after receipt of an appeal request the ADA Coordinator will organize a meeting of the ADA Committee to review and send the complainant a final determination that includes, if applicable, any proposed options for resolution.
  
Please note: **These time limits are intended only as a general framework in which to address and respond to complaints and may be extended by the County as necessary. The County will send correspondence to complainant by email or by mail as specified on the Complaint.
